1. Purpose and Legal Status
This Intellectual Property & Proprietary Rights Notice (the "IP Notice") sets out the ownership, licensing, and permitted use of intellectual property associated with the Polar Tensor™ group's technology, software, content, and branding.
This IP Notice is informational and forms part of the group's legal disclosures. It must be read together with the applicable Terms and Conditions and customer agreements, which govern enforceable rights and obligations.
2. Ownership of Intellectual Property
Unless expressly stated otherwise in a written agreement:
- All intellectual property rights in and to the group's technology, software, algorithms, source code, object code, databases, models, system architecture, documentation, websites, interfaces, dashboards, designs, text, graphics, logos, trademarks, service marks, and brand elements (collectively, "Group IP") are owned by, or validly licensed to, the Polar Tensor™ group.
Group IP may be held at the holding-company level or by designated operating entities and licensed internally on an intercompany basis.
3. Group Entities and IP Roles
The following entities perform defined roles with respect to Group IP:
- Polar Tensor™ Corporation – Acts as the ultimate holding and governance entity and may hold or control intellectual property at group level.
- Polar Tensor™ LAB Limited – Performs research and development activities and contributes to the creation, testing, and improvement of proprietary technology and systems.
- Polar Tensor™ Corp. – Operates licensed execution technology and automated trading infrastructure on a non-exclusive, non-transferable basis.
Other operating entities may use Group IP strictly within the scope of their licensed operational roles.
4. No Transfer of Ownership to Users
Use of any website, platform, application, or service does not result in any transfer, assignment, or conveyance of ownership of Group IP to users.
All rights not expressly granted are reserved.
5. Limited Licence to Users
Subject to compliance with applicable terms:
- users are granted a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the relevant interfaces and technology solely for their intended purpose;
- the licence is limited to personal or authorised business use, as applicable; and
- no rights are granted beyond those strictly necessary to access the services.
The licence automatically terminates upon breach of applicable terms or cessation of service access.
6. Prohibited Uses
Users and third parties must not, without prior written consent:
- copy, reproduce, modify, adapt, translate, or create derivative works from Group IP;
- reverse engineer, decompile, disassemble, or attempt to extract source code or models;
- use Group IP to build competing products or services;
- remove or alter proprietary notices, trademarks, or branding; or
- use Group IP in a manner that infringes applicable law or third-party rights.
7. Trademarks and Branding
All trademarks, logos, trade names, and service marks displayed on the websites or platforms are protected by applicable intellectual property laws.
Unauthorised use of any trademark or branding element is strictly prohibited.
Nothing in this IP Notice grants any licence or right to use trademarks except as expressly permitted in writing.
8. Third-Party Intellectual Property
Certain components or services may incorporate third-party intellectual property.
Such materials remain the property of their respective owners and are subject to applicable third-party terms and licences.
No rights in third-party intellectual property are granted beyond those expressly provided.
9. Enforcement and Remedies
Unauthorised use, infringement, or misappropriation of Group IP may result in:
- immediate suspension or termination of access;
- civil remedies, including injunctive relief and damages; and
- referral to appropriate authorities where applicable.
The group reserves all rights and remedies available under law.
10. No Waiver
Failure to enforce any intellectual property right does not constitute a waiver of such right.
11. Amendments
This IP Notice may be updated from time to time to reflect changes in technology, law, or business operations.
